5. Lawful bases
Depending on the situation and applicable law, we rely on one or more of the following lawful bases:
- Contract: to provide Bizwazi to you and manage your account.
- Legitimate interests: to secure, maintain, improve, and protect the Service and prevent misuse.
- Legal obligation: where we must keep records or respond to lawful requests.
- Consent: where consent is required, such as for optional cookies or optional marketing communications if introduced.
6. Kenyan data protection rights
If Kenya’s Data Protection Act, 2019 applies to your personal data, you may have rights including the right to be informed about the use of your personal data, access your personal data, request correction, request deletion where applicable, object to processing, restrict processing, request data portability where applicable, and withdraw consent where processing is based on consent.
You can make a request by contacting us at hello@bizwazi.com.
7. Sharing and processors
We do not sell personal data.
We may share personal data with trusted service providers who help us operate Bizwazi, such as hosting providers, cloud storage providers, email delivery providers, security providers, analytics providers, customer support tools, and technical service providers. These providers may only process personal data for the purposes of providing their services to us, unless the law allows or requires otherwise.
We may also disclose data where reasonably necessary to comply with law, enforce our Terms, protect the Service, investigate abuse, or protect the rights, safety, and security of users, FLUENT PATH LTD, or others.
8. International transfers
FLUENT PATH LTD is based in the United Kingdom. Bizwazi infrastructure, support, hosting, email, storage, security, and other service providers may be located in the United Kingdom, Kenya, the European Economic Area, the United States, or other countries.
Where personal data is transferred internationally, we use appropriate safeguards where required, such as contractual protections, vendor security controls, transfer assessments, and other measures required or recognised by applicable law.
9. Retention
We keep personal data for as long as needed to provide Bizwazi, manage your account, maintain security, resolve disputes, comply with legal obligations, and keep appropriate backups.
If you delete your account or request deletion, we will handle the request subject to lawful limits, fraud and security checks, technical backup cycles, legal requirements, and any data we must keep to protect our legal rights or comply with obligations.
10. Security
We use reasonable technical and organisational measures designed to protect personal data, including HTTPS, access controls, password hashing, monitoring, backups, and security checks. No online system is completely secure, so you should use a strong password, keep your login details private, and enable extra security features where available.
If you use offline features, some sales and expense information may be stored temporarily in your browser or on your device. You should keep your device secure, use a screen lock where possible, and avoid using offline mode on shared or public devices.
11. Children
Bizwazi is designed for business users and is not intended for children. You must not create an account if you are not old enough to enter into these Terms or lawfully use the Service in your location.
12. Cookies and similar technologies
Bizwazi uses cookies and similar technologies mainly for authentication, session management, security, and essential service operation. For more information, see our Cookie Policy.
We may also use browser storage, such as local storage or IndexedDB, to support essential app functions including offline sales and expense recording.
13. Offline use and local device storage
If you add a sale or expense while your internet connection is weak or unavailable, Bizwazi may temporarily save that sale or expense in the browser on the device you are using.
For example, if you add an expense offline on your phone, it is saved in that phone’s browser storage. It will not automatically appear on your laptop or another device until that phone goes back online and the record syncs to your Bizwazi account.
When your connection returns, Bizwazi will try to sync the offline sale or expense to your online account. After a successful sync, Bizwazi may remove or reduce the temporary offline copy where technically possible.
Because offline records are stored on the device and browser you are using, you should keep your device secure, use a screen lock where possible, and avoid using offline mode on shared or public devices.
14. Your rights and requests
Depending on your location and applicable law, you may have rights to:
- Access personal data we hold about you
- Correct inaccurate or incomplete data
- Delete personal data, subject to lawful limits
- Restrict or object to certain processing
- Receive a copy of certain data in a portable format where applicable
- Withdraw consent where processing is based on consent
To exercise your rights, contact hello@bizwazi.com. We may need to verify your identity before responding to a request.
15. Complaints
Please contact us first if you have a privacy concern so we can try to resolve it.
If you are in Kenya, you may also have the right to contact the Office of the Data Protection Commissioner. If you are in the United Kingdom, you may have the right to contact the Information Commissioner’s Office.
16. Changes
We may update this Privacy Policy from time to time. Updates will be posted on this page with a new effective date. If a change is important, we may also provide notice in the Service or by email where appropriate.
